摘要
Inrecentyears,thefrequentoccurrencesofmarineoilspillshavealreadybecomeoneofthemajorreasonsthreateningthemarineecologicalsafetyofChina.Intheeventofoilspill,oth-erthantakingthenecessaryemergentmeasuresaimingspecificallyatthedamagetothemarineecologyandenvironment,usinglegalmeanstoassurethatthedamageliabilitiesarebornebytherespon-siblepersonstoprotectthenationalinterestsarealsoveryneces-sary.Thispaperadvancesfiverecommendationsregardingthedevelopmentofasystemforecologicallegalcompensationsfromthestandpointofthecurrentstatusoflegislationandexecutionofthelawsoncompensationofoilspillpollutingmarineecosystem.Thesefiverecommendationsinclude:determinationofthestatusofjuristicactioninmarineecologicalandenvironmentalcompen-sationsinaccordancewiththelaws,determinationofplaintiffofmarineecologicalandenvironmentalcompensationsinaccordancewiththelaws,determinationofthefourbasicprinciplesinthele-galactionsofmarineecologicalandenvironmentalcompensationsinaccordancewiththelaws,determinationofassessmenttechnicalstandardofmarineecologicalandenvironmentaldamagesinac-cordancewiththelaws,anddeterminationofthescopeofmarineecologicalandenvironmentalcompensationsinaccordancewiththelaws.
